This study aims to fill a gap in academic literature, where most research has focused on psychotic or neurodegenerative conditions, rather than <strong>depressive disorders<\/strong>.<\/p>\n<p><strong>Methodology<\/strong><\/p>\n<p>The research involved a dual approach:<\/p>\n<ol>\n<li><strong>Legal Case Analysis:<\/strong><br \/>\nExamination of 101 relevant Greek court rulings involving 107 wills (1999\u20132020), accessed via the legal databases <em>Isokratis<\/em> and <em>NOMOS<\/em>.<\/li>\n<li><strong>Psychometric Evaluation:<\/strong><br \/>\nDistribution of validated tools to 100 adult participants:<\/p>\n<ul>\n<li><em>Mini-Mental State Examination (MMSE)<\/em><\/li>\n<li><em>Capacity for Legal Financial Transactions Scale (CLFS)<\/em><\/li>\n<li><em>Geriatric Depression Scale (GDS)<\/em><br \/>\nStatistical correlations between the participants&#8217; scores were assessed.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p><strong>Key Findings<\/strong><\/p>\n<ol>\n<li><strong> <em>Court Decision Analysis:<\/em><\/strong><\/li>\n<\/ol>\n<p><\/p>\n<ul>\n<li>49.5% of wills were deemed valid by the courts.<\/li>\n<li>48.3% of wills involving testators with <strong>psychiatric\/neurological disorders<\/strong> were ruled invalid \u2014 a significantly higher proportion compared to those with purely somatic illnesses (36.1%).<\/li>\n<li>Only 2.8% of testators had a known history of clinical depression.<\/li>\n<li>57.9% of testators had some form of mental health disorder.<\/li>\n<li>26% of decedents had executed more than one will.<\/li>\n<\/ul>\n<p><\/p>\n<ol start=\"2\">\n<li><strong> <em>Psychometric Results:<\/em><\/strong><\/li>\n<\/ol>\n<p><\/p>\n<ul>\n<li>51.2% of participants exhibited <strong>severe depressive symptoms<\/strong>, and 46.5% showed <strong>mild symptoms<\/strong>.<\/li>\n<li>Those with severe symptoms scored <strong>significantly lower<\/strong> on financial competence and object valuation scales.<\/li>\n<li>Strong correlations were found between depressive symptom intensity and impaired financial judgment.<\/li>\n<li>However, <strong>no statistically conclusive evidence<\/strong> was found to completely disqualify depressed individuals from legal capacity based solely on depressive symptoms.<\/li>\n<\/ul>\n<p><strong>Conclusion<\/strong><\/p>\n<p>This interdisciplinary study\u2014combining jurisprudential analysis with psychological assessment\u2014reinforces the legal-medical consensus: <strong>a psychiatric diagnosis alone does not automatically negate a person&#8217;s legal capacity<\/strong>.<\/p>\n<p>Further research is necessary to precisely evaluate <strong>how and when depression impacts testamentary capacity<\/strong>, particularly in marginal or borderline cases.
