{"id":2001,"date":"2025-02-28T16:06:04","date_gmt":"2025-02-28T14:06:04","guid":{"rendered":"https:\/\/prili-law.gr\/commercial-property-leases-in-greece-after-law-4242-2014\/"},"modified":"2025-02-28T16:06:04","modified_gmt":"2025-02-28T14:06:04","slug":"commercial-property-leases-in-greece-after-law-4242-2014","status":"publish","type":"post","link":"https:\/\/prili-law.gr\/en\/commercial-property-leases-in-greece-after-law-4242-2014\/","title":{"rendered":"Commercial Property Leases in Greece After Law 4242\/2014"},"content":{"rendered":"<p><strong>Commercial leases in Greece<\/strong> refer to tenancy agreements signed for the purpose of conducting business or professional activities within the leased property.<\/p>\n<p>These leases are regulated under <strong>Presidential Decree No. 34\/1995<\/strong>, and apply to various professional uses, including:<\/p>\n<ul>\n<li>Educational institutions and daycare centers<\/li>\n<li>Clinics and healthcare facilities<\/li>\n<li>Auxiliary premises to other properties<\/li>\n<li>Pharmacies and pharmaceutical warehouses<\/li>\n<li>Nursing homes<\/li>\n<li>Law offices, medical and dental practices, architectural or engineering firms<\/li>\n<li>Notary offices, bailiffs, veterinary clinics, accounting offices, land registry agents<\/li>\n<li>Recognized charities governed by Law 2039\/1939<\/li>\n<\/ul>\n<p><strong>Legal Framework: Modernization of Lease Law<\/strong><\/p>\n<p>Commercial leases entered into on or after <strong>February 28, 2014<\/strong>, are governed by:<\/p>\n<ul>\n<li><strong>Presidential Decree 34\/1995<\/strong>, as amended by:\n<ul>\n<li>Law 2749\/1999<\/li>\n<li>Law 4242\/2014<\/li>\n<li>Law 4257\/2014<\/li>\n<li>Law 4264\/2014<\/li>\n<li>Law 4335\/2015<\/li>\n<li>Law 4373\/2016<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Additionally, general provisions of the <strong>Greek Civil Code<\/strong> apply.<\/p>\n<p><strong>\u00a0Rights and Obligations of the Parties<\/strong><\/p>\n<p><strong>Obligations of the Landlord:<\/strong><\/p>\n<ul>\n<li>Must deliver the property in a <strong>suitable condition<\/strong> for the agreed use.<\/li>\n<li>Is responsible for <strong>necessary repairs and maintenance<\/strong>.<\/li>\n<li>May require a <strong>security deposit<\/strong>, refundable upon lease termination.<\/li>\n<\/ul>\n<p><strong>Obligations of the Tenant:<\/strong><\/p>\n<ul>\n<li>Must <strong>pay rent on time<\/strong> and use the property <strong>only for the agreed purpose<\/strong>.<\/li>\n<li>Cannot change the use of the property (e.g., from business to residential).<\/li>\n<li>Is responsible for <strong>avoiding damage<\/strong> and <strong>paying utility and communal expenses<\/strong>.<\/li>\n<\/ul>\n<p><strong>\u23f3 Minimum Lease Duration (Law 4242\/2014)<\/strong><\/p>\n<p>Law 4242\/2014 introduced a <strong>mandatory minimum lease term of three (3) years<\/strong>, even if the parties agree to a shorter term or fail to specify a duration in the lease agreement.<\/p>\n<p>\u2705 If a <strong>longer lease term<\/strong> is agreed, it remains valid.<\/p>\n<p>\ud83d\udd01 <strong>Indefinite-term leases<\/strong>: If the tenant remains after the fixed term with the landlord\u2019s silent consent, the lease continues <strong>indefinitely<\/strong> under Article 611 of the Greek Civil Code.<\/p>\n<p><strong>\u274c Termination and Expiry of Lease<\/strong><\/p>\n<p>Commercial leases may terminate:<\/p>\n<ul>\n<li><strong>Automatically<\/strong>: Upon the lapse of the agreed or statutory term.<\/li>\n<li><strong>By notice<\/strong>: Either party may terminate the lease <strong>after the minimum or agreed term<\/strong>, with <strong>three (3) months\u2019 notice<\/strong>, and <strong>no obligation for compensation<\/strong>. Rent must still be paid during this notice period.<\/li>\n<\/ul>\n<p><strong>Abolished Grounds for Termination<\/strong><\/p>\n<p>Law 4242\/2014 abolished some previously valid termination reasons:<\/p>\n<ul>\n<li>Termination for <strong>personal use<\/strong> or <strong>reconstruction<\/strong><\/li>\n<li>Termination due to <strong>bankruptcy<\/strong> of the tenant<\/li>\n<li>Special compensation of <strong>24 months<\/strong> for termination after a 12-year lease<\/li>\n<\/ul>\n<p><em>Note<\/em>: Termination by public authorities for public service needs remains valid.<\/p>\n<p><strong>\u26a0 Early Termination for Good Cause<\/strong><\/p>\n<p><strong>Early termination is allowed<\/strong> only for <strong>\u201cserious cause\u201d<\/strong>, which courts interpret <strong>strictly<\/strong>.
