Αλλαγή χρήσης σε κατοικία: Τι αλλάζει με τον Ν. 5322/2026 • Residential Conversion in Greece: Law 5322/2026 Explained

📌Αρκεί η ενημέρωση της Ταυτότητας Κτιρίου;

📌Επιτρέπεται η βραχυχρόνια μίσθωση;

Residential Conversion in Greece: What Changes Under Law 5322/2026?

Converting an existing building into residential accommodation may offer property owners a new route to making use of vacant or underused premises. In Greece, Article 56 of Law 5322/2026 expands the circumstances in which this change of use is permitted.

The legislation introduces exceptions to existing planning rules for properties both within and outside approved town plans. However, eligibility depends on the building’s legal status, location and planning history.

📌Residential Conversion Within Town Plans and Settlements

For lawfully existing buildings within an approved town plan or settlement, the new provisions allow a change to residential use by exception to the applicable land-use rules.

The provisions also cover buildings granted planning derogations by 31 December 2025. A favourable opinion from the Central Council of Architecture is required before the building permit for the new use is issued.

📌Converting Buildings Outside Town Plans

For lawfully existing buildings outside approved town plans and settlement boundaries, the new framework permits residential conversion by exception to applicable land-use provisions, building restrictions and specified planning regimes.

The conversion is permitted once only and must remain within all or part of the existing lawful building envelope. It cannot increase the building’s volume, floor area or site coverage.

The provisions also extend to buildings for which the regularisation procedure under Laws 4178/2013 or 4495/2017 has been completed.

📌The 5% Fee: What Property Owners Should Know

The provision addressing buildings outside town plans with planning derogations granted by 31 December 2025 includes a favourable opinion from the Central Council of Architecture and a special compensatory fee.

The fee equals 5% of the land’s statutory objective value, assessed when the application is submitted. It is payable in a single instalment to the Green Fund before the relevant permit or change-of-use approval and cannot be offset against other fees or contributions.

Owners should establish how this provision applies to their property before preparing a conversion budget.

📌Is Updating the Electronic Building Identity Enough?

The new exceptional conversion routes are expressly excluded from the simplified procedure available for certain ordinary changes of use.

Accordingly, owners should not assume that updating the Electronic Building Identity alone will authorise the conversion. The applicable permit process must be assessed for the proposed project.

📌Can the Converted Property Be Used for Short-Term Rentals?

Homes created through these exceptional provisions cannot be offered for short-term rental for at least five years after the residential change of use is completed.

This restriction is particularly relevant when assessing a property purchase or preparing an investment plan based on holiday accommodation.

What to Check Before Starting a Residential Conversion

A preliminary assessment should examine the building permit, approved drawings, any planning derogations and the completion status of previous regularisation procedures.

Legal due diligence should also address ownership documents, condominium regulations and restrictions affecting the intended use. Planning permission does not, by itself, resolve private-law restrictions.

For owners and investors considering a residential conversion in Greece, early legal and technical assessment can help establish feasibility, identify the necessary approvals and support a realistic project budget.
